A man charged with causing the deaths of two teenage friends in a 2017 crash in Quigley’s Point has been refused bail.
Ricky Fagan was remanded in custody by Judge Ciaran Liddy when he appeared before Letterkenny District Court on Thursday.
The 31-year-old has been charged with dangerous driving causing the deaths of Nathan Fullerton (17) and Nathan Farrell (18) at Quigley’s Point on April 29, 2017.
Fagan, who was extradited to Donegal from Northern Ireland on foot of a European Arrest Warrant earlier this week, was further charged with the possession of cocaine and with possessing cocaine with the intent to sell or supply it to others. Those charges relate to an incident at Mulberry Avenue, Buncrana, on July 10, 2020.
Fagan, whose address was previously given as Mulberry Avenue in Buncrana, was initially brought before Carndonagh District Court on Tuesday.
Mr Donough Cleary, solicitor for Fagan, applied for bail on behalf of his client on Thursday.
Sergeant Graham Morgan of Carndonagh Garda Station said the State was objecting to bail. Sergeant Morgan said there were “grave concerns” that Fagan would not show up for trial.
Sergeant Morgan asked that bail be refused due to the seriousness of the charge and the strength of the evidence.
Mr Cleary told the court that Fagan’s passport is in the possession of the Police Service of Northern Ireland (PSNI).
Judge Liddy said that Fagan is facing “serious charges”. He said that while the accused has no passport he could “walk across the border unchecked” and, on balance, he considered that Fagan is a flight risk.
Fagan was remanded in custody to appear before the court on February 4 by video linkl.
Fagan was the alleged driver of a car in which Mr Fullerton and Mr Farrell were travelling in, along with two other friends, on April 29, 2017. The car hit a wall before crashing into a tree on the Quigley’s Point to Moville road at around 3.35am.
The friends were returning home from a night out at a disco at the time.
